The evidence of serious criminality on the part of Bush administration leadership goes so far and so deep that, curiously, we've almost forgotten about it. But it has been the air this country has breathed now for eight years. Time to clear the air -- the end of the administration's tenure should not mean an end to criminal prosecution.
Abu Ghraib was never, ever an exception. It was permitted, enabled, authorized and pre-meditated by Bush, Cheney, Yoo, Rumsfeld, Miller, and Addington, among many others. The techniques testified to correspond with chilling accuracy to techniques authorized by the president, for which we now have overwhelming evidence.
Andrew Sullivan ticks off some of the pending indictments for war crimes. "Pending," because something must be done. Forgetting is not an option for a responsible nation. Having a constitutional law expert in the Oval Office might be an effective start.
I'd be agreeable to the establishment of a South Africa-style Truth & Reconciliation convention. Drag all the Yoo's, and Gonzalez's, tortures, and pigf***ers this administration has employed before a public tribunal with the understanding that if they spill their guts, they're off the hook.
Barring that, I think Obama will have a duty to charge his Justice Department with the job of ferreting out and exposing the crimes of the Bush administration, for all to judge. The people's right to know what has been done in their name is absolute.
