What this means, as Marty Lederman puts it, is that Durham is neither an "outside," nor "special," nor "independent" prosecutor. "Durham will still report to the Deputy Attorney General, who in turn reports to Judge Mukasey."
Seeping out, rather than breaking, are revelations about Benazir Bhutto's contacts with Senator Specter and Representative Patrick Kennedy. The story is that Bhutto was to give them a file demonstrating that Pakistan's all-power intelligence agency, ISI, was rigging the elections. But she was killed within hours of meeting with Specter and Kennedy. Reports first appeared in overseas media, in AP, and then in McClatchy and CNN. Crooks and Liars has posted it today.
Also oozing out these days (albeit invisibly to some) is evidence that in getting Hillary, we'd be getting Bush redux. Oh, we know: a lot of people think this is so unfair! But the same people might have had the same notion back in 2000 when some of us were dubious about that cute guy a lot of voters wanted to have a beer with. Hark ye: there's enough to make us believe Andrew Sullivan is right. Clinton does indeed show signs of the same "instinctive bunker mentality" as Bush 2. And, in another respect, are Sullivan's sources right about Giuliani, too?
